- January 5, 1972 Potato Research and Promotion Plan- Establishes procedures used by the USDA when conducting an initial referendum to determine whether the issuance of the proposed Potato Research and Promotion Plan under the Potato Research and Promotion Act of 1971, as published rule, is favored by the Potato industry. Eligible producers voted during the referendum period to determine if they favored the issuance of the plan. Approval was granted by a majority of producers voting, who also represented a majority of volume voting voted in favor. [37 FR 5008]. Effective: March 02, 1972
- August 26, 1972 Potato Research and Promotion Plans; Rules and Regulation- Establishes the National Potato Promotion Board pursuant to the Potato Research and Promotion Act. Under the Act and Plan, this rule sets the Rules and Regulations and requires handlers to pay an assessment to the Board per hundredweight of potatoes. [37 FR 17379]. Effective: September 15, 1972
- March 12, 1973 Potato Research and Promotion Plan: Terms of Office- Establishes term of office beginning on April 1st and ending three years later on March 31st. All members are to serve the entirety of the term and until a qualified successor is selected. [38 FR 7123]. Effective March 16, 1973
- February 24, 1975 Potato Research and Promotion Plan; Rules and Regulations; Payments of Assessments, Designated Handler- Clarifies the designated handlers responsibility to pay assessments by removing the provision that a producer may pay assessments on behalf of the designated handler. [40 FR 6893]. Effective: February 28, 1975
- October 17, 1977 Potato Research and Promotion Plan; Rules and Regulations; Assessments- Further clarifies the responsibility of potato handlers regarding assessments on seed potatoes and when the assessments are to be paid, as well as the procedure for receiving a refund. [42 FR 55879]. Effective: October 20, 1977
- March 01, 1978 Potato Research and Promotion Plan; Rules and Regulation; Amendment Regarding Designated Handler- Clarifies that a designated handler is the first handler of potatoes. Producers who sell seed potatoes to other producers are considered handlers, therefore must pay required assessments. Producers who use their own seed potato for plantings are not required to pay assessments as this is not classified as entering the channel of commerce. [43 FR 9133]. Effective: March 06, 1978
- October 30, 1978 Potato Research and Promotion Plan; Rules and Regulations; Amendment Regarding Designated Handler- Clarifies responsibilities of seed potato producers. Seed potato producers are the designated handler and are required to pay assessments unless this producer can prove the person who obtained the potatoes disposed of them in another way besides planting. [43 FR 51001]. Effective: November 03, 1978
- April 26, 1979 Potato Research and Promotion Plan; Amendment Regarding Administrative Committee- This adds a fourth Vice President to the Board. When geographic distribution is considered, the Northwest region accounts for 50% of annual production. Due to the need for adequate representation, the Board is adding an additional member and alternate seat, for the Northwest region. [44 FR 25621]. Effective: May 02, 1979
- January 13, 1984 Potato Research and Promotion Plan, Amendment Regarding Potato Board Member Term of Office- Adjusts the term of office to March 1 and ending three years later on the final day of February. This action allows the Board to align meetings with terms of office. [49 FR 2093]. Effective: January 18, 1984
- May 11, 1984 -Potato Research and Promotion Plan; Issuance of Amendment Regarding Assessment; Public Representation and USDA Reimbursement of Administrative Expenses-Authorizes an assessment increase and adds a public member to the Board. The public member must be nominated by producer members and have no direct financial interest in the production or marketing of potatoes. [49 FR 20806] Effective: May 17, 1984
- June 04, 1984 Potato Research and Promotion Plan, OMB Control Number Assigned to the Paperwork Reduction Act- The Office of Management and Budget approves the Paperwork Reduction Act to now included in the Potato Act and Plan. The report number is No.0481-0093. [49 FR 23826] Effective: June 08, 1984
- June 22, 1984 Potato Research and Promotion, Amendment of Rules and Regulations- Increases the assessment rate to two cents per hundredweight of potatoes. Additionally, this rule specifies the Board is responsible for reimbursing the USDA for administrative expenses incurred during oversight. [46 FR 26202] Effective: June 27, 1984
- August 02, 1984 Potato Research and Promotion Plan; Issuance of Amendment Regarding Assessment; Public Representation and USDA Reimbursement of Administrative Expenses; Correction- Added the word “initially” to the passage on FR Doc. 84-13343 page 20805. The new sentence reads “…, such State shall initially be entitled to one member.” [49 FR 31390] Effective: August 07, 1984
- June 12, 1985 Potato Research and Promotion; Administrative Committee- Establishes annual selections of the Administrative Committee are to be selected by the Board. The committee had to include 25 producers, 1 public member, and 1 importer. Positions of Chair Member, Secretary, Treasurer and Vice Presidents were up to the discretion of the Board. [50 FR 25199]. Effective: June 18, 1985
- August 9, 1991 Potato Research and Promotion Plan; Amendments to the Plan, Rules and Regulations Issued Thereunder, Procedure for the Conduct of Referenda, and the Order Directing That a Referendum be Conducted- Responded to the decision to amend the Plan instated by the Food, Agriculture, Conservation and Trade Act of 1990. The rule clarifies the Plan’s procedures of referendum, voting, terms of membership, duties, assessments, refunds, reports, et al. Definitions of the terms Act, potato, importer, and customs were specified. [56 FR 40229]. Effective: August 14, 1991
- September 02, 1992 Potato Research and Promotion Plan; Termination of Obsolete Provisions of the Plan and Amendments to the Rules and Regulations issued Thereunder- Responded to the Potato Research and Promotion Act of 1971 in terms of including the commodities of frozen and processed potatoes for the consumption of humans in the Order. The Act mandated an assessment rate for domestic potatoes at 0.2 cents per hundredweight. [57 FR 40083]. Effective: November 02, 1992
- December 31, 1992 Potato Research and Promotion Plan; Levy of Assessments- Establishes that all imported seed potatoes and products for human consumption to have a levied assessment of 0.2 cents per hundredweight. Importers paid assessments directly to customs upon entry to the United States to which products are identified through Harmonized Tariff Schedule Codes. Potato starch is a nonhuman commodity but was added to have a conversion factor from fresh weight for assessments. [58 FR 3359]. Effective: January 08, 1993
- August 22, 1994 Potato Research and Promotion Plan; Administrative Committee- Supports the establishment of an Administrative Committee composed of producers, importers, and a public member. Members were reviewed and selected annually by the Board. [59 FR 44036]. Effective: August 26, 1994
- September 02, 1997 Potato Research and Promotion Plan; Suspension of Portions of the Plan; Amendments of the Regulations Regarding Importers' Votes; Clarification of Reporting Requirements- Changes how Board members assume position and allows for the issuance of ballots for voting purposes. Industry members no longer need to be appointed to the Board at meetings specifically. The rule also removed the requirement that importer positions had to be held by organizations. Importers were also allowed to vote on the same fresh weight basis as domestic producers. [62 FR 46179]. Effective: September 03, 1997
- January 14, 2005 Exempting Organic Producers From Assessment by Research and Promotion Programs - In accordance with the 2002 Farm bill, this final ruling exempts certain agricultural commodity programs from paying assessments. The National Organic Program authorizes individuals that produce authorized organic products to be exempt from having to pay assessments. Certification requires the producer to retail only 100 percent organic products [70 FR 2755]. Effective: February 14, 2005
- March 07, 2006 Amendments to the Potato Research and Promotion Plan- States that in order to continue and maintain research projects and promotions, there must be a ½ cent increase to assessment rates, totaling 2.5 cents per hundredweight. [71 FR 11296]. Effective: March 08, 2006
- August 25, 2006 Amendments to the Potato Research and Promotion Plan- Published on March 08, 2006 by the federal register to correct the authority citation, Harmonized Tariff Schedule codes, and proclaimed that hundredweight of potatoes are levied at 2.5 Cents. U.S. Customs now processes imported table stock, seed, and potato products. Effective: September 25, 2006
- December 22, 2006 Potato Research and Promotion Plan; Amendment of Administrative Committee Structure- Supported the restructuring of the committee with the addition of a Seventh Vice President. [71 FR 76901]. Effective: December 26, 2006
- December 04, 2009 Potato Research and Promotion Plan; Assessment Increase- Establishes an increase in assessment by ½ Cent. The rate totaled to be 3 cents per hundredweight. [74 FR 63543] Effective: December 07, 2009
- March 26, 2010 Potato Research and Promotion Plan- Corrected the citation for customs name and Harmonized Tariff Schedule codes for table stock potatoes, frozen or processed potatoes, and seed potatoes. The HTS codes changed dependent on Cents/cwt or Cents/kg. [75 FR 14491] Effective: March 26, 2010
- August 22, 2013 Potato Research and Promotion Plan; Amend the Administrative Committee Structure and Delete the Board's Mailing Address – The purpose of this rule was to support the Board as they amended the plan to introduce two additional Vice President positions. The position was intended to represent the North Central production region. Also, the Board physically relocated within Denver. The Board decided against publishing their new address moving forward to prevent conflict for future regulations and potential relocations. [78 FR 52082]. Effective: August 23, 2013
- December 31, 2015 Exemption of Organic Products From Assessment Under a Commodity Promotion Law-This rule applies to all 22 research and promotion programs. People that produce, handle, process, market, manufacture, or import organic certified products are exempt from paying assessments. To be considered Organic, the product must be labeled “Organic” or “100% Organic”, along with proper certification from the National Organic Program. Commodities that are not accepted as Organic must fulfill the Assessments to their proper boards. There are opportunities to apply for Organic exemption via the Board. [80 FR 82024]. Effective: February 29, 2016
- April 15, 2022 Amendments to the United States Potato Board Membership and Assessment Methods- Changes the source of data for Board member seat recognition to be from audited assessment reports instead of from the National Agricultural Statistics Service for expense purposes. Assessment billings are now permitted to be electronically processed. The rule also added language to the Plan that addressed updating the HTS codes without having to amend the Plan. [87 FR 22435]. Effective: May 16, 2022.
- January 8, 2024 Potato Research and Promotion Plan; Changes to Board Membership and Administrative Committee Changes the membership and organization by revising the formula used to determine the number of producer and importer seats on the Board, reducing the maximum number of importer seats on the Board, and indefinitely suspending the Administrative Committee. [ 89 FR 859] Effective: February 7, 2024.
