Order Authority and Regulations

The marketing order authorizes quality regulations and container and pack regulations for potatoes grown in Colorado’s San Luis Valley (Area II) and Northern Colorado (Area III).  The order went into effect on August 28, 1941, and was last amended under formal rulemaking July 27, 1960. View the full regulation.

  • Quality Regulations:  The marketing order authorizes grade, quality, maturity, and size regulations to maintain potato quality shipped to consumers.  These requirements in effect under the marketing order also are applied to imports of round-type potatoes, other than red-skin varieties, during each month of the year, due to 8e requirements.
    • 8e Requirements: The 8e requirements specify that commodity imports must meet the same or comparable minimum grade, size, quality, and maturity requirements as those specified under this marketing order. Imports of round-type potatoes, other than red-skinned varieties, must meet the requirements of Area II (San Luis Valley) throughout the entire year.  Learn more about importing potatoes.
  • Research and Promotion: Market research and development programs are authorized under the order, but no such programs are currently active.
  • Markings, pack, and container regulations:  The marketing order authorizes regulations on the marking or labeling, size, capacity, and weight of the containers used to ship potatoes to market.
Committee Structure

The order is administered locally by the two active Area committees, together with the Colorado Potato Committee. The Area II Committee (pdf) consists of nine producer members and five handler members. The Area III Committee (pdf) consists of three producer members and two handler members. Each of the members on both committees has one alternate.
