Washington, D.C., Oct. 2, 2026 – On Aug. 5, 2026, the U.S. Department of Agriculture (USDA) signed a Consent Decision and Order with ADD Enterprises Inc (ADD Enterprises) and Salvatore Anthony DiMaria (DiMaria) of Pico Rivera, Calif., settling an administrative complaint USDA filed on Jan. 8, 2026, for alleged violations of the Packers and Stockyards (P&S) Act.
A USDA investigation revealed that between August 2022 and August 2025, ADD Enterprises and DiMaria failed to pay $25,272,512 for livestock purchases, in violation of the P&S Act. The P&S Act requires regulated entities to issue full payment for livestock by the close of the first business day following the purchase and transfer of possession. The livestock sellers were notified of their right to file packer trust claims for the outstanding amounts owed to them for their livestock. As of the date of the complaint, the trust showed $24,593,660, remained unpaid.
Under the Consent Decision and Order, ADD Enterprises and DiMaria were ordered to cease and desist from failing to pay, or failing to pay when due, the full purchase price of livestock, and using trust funds in any way except for the proper preservation and administration of the trust, and payment of any trust claims adjudicated as owed.
ADD Enterprises and DiMaria were assessed a civil penalty in the amount of $24,593,660, which is equal to the amount owed to livestock sellers. The civil penalty can be reduced, dollar for dollar, by any amount ADD Enterprises and DiMaria make in payments to unpaid livestock sellers or by any amount satisfied, as ratified by the livestock sellers themselves. ADD Enterprises and DiMaria will be in breach of order if they fail to pay the civil penalty within a year.
The Secretary of Agriculture has authority to act against violators, including issuing cease and desist orders, suspending registrations, and imposing other remedies as authorized by the P&S Act.
