The Commodity Procurement Staff of the Agricultural Marketing Service would like to inform the industry that the 1 00% small business set aside has been removed for material number 11 0260- Frozen Fine Ground Beef Lft Opt Pkg. - 4011 lb., and the 1 00% small business set aside has been reduced to 50% for material numbers 100158-Frozen Fine Ground BeefCtn.--40 lb. and 100159- Frozen Fine Ground BeefPkg.-4011 lb. In accordance with the Federal Acquisition Regulation Part 19.502-2(b) "The contracting officer shall set aside any acquisition over $150,000 for small business participation when there is a reasonable expectation that (1) offers will be obtained from at least two responsible small business concerns offering the products of different small business concerns; and (2) award will be made at fair market prices." Recent findings have revealed that there are not at least two small businesses that can supply material number 110260- Frozen Fine Ground Beef Lft Opt Pkg. - 40/1 lb. Findings also revealed that limited quantity of beef available in the market today preclude small businesses from being able to supply material numbers 100158- Frozen Fine Ground BeefCtn.--40 lb. and 100159-Frozen Fine Ground BeefPkg.-40/llb. in sufficient quantity to meet the needs of the recipients.
Therefore, material number 110260, Frozen Fine Ground Beef Lft Opt Pkg. - 4011 lb. will be procured on a full and open basis, and material numbers 100158-Frozen Fine Ground BeefCtn.-40 lb. and 1 00159-Frozen Fine Ground Beef Pkg.-4011 lb. will be procured as a 50% small business set aside for future solicitations.
