Appeals
A laboratory that has been involuntarily removed from the program may file a written appeal with the Deputy Administrator of the Science and Technology Programs supported by any argument and evidence as to why the laboratory should not be removed from the program. Within 30 days of receipt of the written appeal, the Deputy Administrator shall make a determination and take such action, as deemed appropriate, with respect to the removal. When an appeal to the Deputy Administrator of the Science and Technology Programs is not resolved to the satisfaction of a laboratory, the appeal may be filed with the Administrator of Agricultural Marketing Service. Within 90 days of receipt of the written appeal, supporting arguments, and evidence, the Administrator shall make a determination and take such action, as deemed appropriate, with respect to the removal.
